01General Provisions
These Terms of Service (the "Terms") govern the relationship between you and the operator of the KoloPlus platform (the "Platform", "we"), available at kolo.plus. By registering or using the Platform, you confirm that you have read and agree to these Terms. If you do not agree, please do not use the Platform.
02Definitions
- Platform - the KoloPlus web service (kolo.plus).
- User - a person who registers or uses the Platform.
- Content - any material published on the Platform.
- Virtual items - in-app currency and items with no real monetary value.
03Registration and Account
Full access to the Platform is available to persons aged 18+. Persons aged 9-17 may use the Platform only with the consent of a legal guardian (the consent is recorded) and in kids game mode: the game (Arena, market, shop, forge) is open; feed, posting, wall messages and classifieds are closed. For ages 9-12, private messages, media uploads, geolocation and all advertising are additionally disabled; for 13-17 ads are non-targeted only (Art. 8 GDPR; Art. 28 Regulation (EU) 2022/2065 (DSA); Civil Code of Ukraine). Persons under 9 are not permitted; discovered accounts are deleted together with their data. You are responsible for keeping your credentials safe and for activity under your account. One user - one account, unless rules permit otherwise.
04Licence to Use
We grant you a limited, non-exclusive, non-transferable right to use the Platform for personal, non-commercial purposes under these Terms. This right may be revoked upon breach.
05User Content
You retain rights to your content. By posting it, you grant us a non-exclusive, royalty-free licence to store, reproduce and display it for the Platform's operation. You warrant that you hold the necessary rights.
06Code of Conduct
Prohibited: violating Ukrainian or EU law; posting unlawful, abusive or discriminatory content or incitement to violence; infringing intellectual property; distributing spam or malware; fraud; attempting unauthorised access to systems or accounts.
07Game Mechanics and Virtual Items
The Platform includes game mechanics and in-app currencies/items (gold, crystals, ducats, etc.). They are not money, have no real value, are not exchangeable for real money and are non-refundable, except as required by law. We may modify or discontinue the virtual economy.
08Payments and Top-ups
Where the Platform offers paid services or top-ups, terms and prices are shown at purchase. EU/Ukrainian consumers have rights of withdrawal and refund under consumer law, subject to exceptions for digital content consumed with the user's consent.
09Intellectual Property
All rights to the Platform, its design, code, trademarks and content (other than user content) belong to the operator and are protected by law. Use without permission is prohibited.
10Disclaimer of Warranties
The Platform is provided "as is" and "as available". To the extent permitted by law, we do not warrant uninterrupted or error-free operation.
11Limitation of Liability
To the extent permitted by law, we are not liable for indirect damages, loss of data or profit. This does not limit mandatory consumer rights.
12Suspension and Deletion
We may suspend or delete an account for breach of these Terms. You may delete your account at any time in the settings (see Account Deletion).
13Dispute Resolution
The parties will seek to resolve disputes through negotiation. Failing agreement, disputes are governed by Ukrainian law. EU consumers may use the Online Dispute Resolution (ODR) platform and retain the protection of their country of residence.
14Changes to the Terms
We may amend these Terms. Material changes will be announced on the Platform. Continued use constitutes acceptance.
